The best protection measures that property owners can have in their defense are Tree Risk Assessments and documentation of the care that a Licensed Tree Care Professional provided to the tree. This will likely show the court that the owner has taken all appropriate measures to properly maintain and keep the tree as safe a possible. This will normally result in the ruling being deemed an "Act of God", and relinquishes the owner from being responsible for the damages.
